Terms and Conditions of Service

  1. Introduction
    1.1 These Terms and Conditions (“Agreement”) govern the logistics and transportation services provided by Quickcom Express. (“the Company”, “we”, “us”, “our”) to the client (“the Client”, “you”, “your”).
    1.2 By engaging in any business transactions or using our services, the Client agrees to be bound by these Terms and Conditions. If the Client does not agree with these Terms, they should not use our services.
  2. Client Obligations
    3.1 The Client must provide accurate and complete information regarding the goods to be transported, including their nature, weight, size, and any special handling requirements.
    3.2 The Client is responsible for ensuring that the goods are properly packed and labeled in accordance with legal and regulatory requirements.
    3.3 The Client must comply with all applicable laws, including customs and import/export regulations.
  3. Pricing and Payment
    4.1 The Company will provide a quote for services based on the specific logistics needs of the Client.
    4.2 All charges are subject to change, and the Company will notify the Client in writing of any changes.
    4.3 Payment is due in full before services are rendered unless otherwise agreed in writing. Late payments may incur additional fees.
  4. Liability and Insurance
    5.1 The Company will exercise reasonable care and diligence in providing services. However, the Company’s liability for loss, damage, or delay to goods will be limited to the extent allowed by law.
    5.2 The Client is encouraged to obtain adequate insurance coverage for their goods during transportation. The Company’s liability may be limited if the Client has not obtained such insurance.
  5. Delivery and Transit
    6.1 Delivery times are estimates and are not guaranteed unless specifically agreed upon.
    6.2 The Company is not liable for delays caused by circumstances beyond its control, including but not limited to weather, traffic, strikes, or customs delays.
  6. Force Majeure
    7.1 The Company will not be liable for any failure to perform its obligations under this Agreement due to events outside of its reasonable control, including but not limited to natural disasters, war, strikes, or government restrictions.
  7. Termination
    8.1 Either party may terminate this Agreement with written notice if the other party breaches a material term of the Agreement and fails to remedy the breach within a specified period.
    8.2 The Client may also terminate services if the Company fails to meet agreed delivery standards, but only after providing written notice and a reasonable opportunity to remedy the situation.
  8. Confidentiality
    9.1 Both parties agree to maintain the confidentiality of all confidential or proprietary information received during the course of the Agreement.
  9. Governing Law
    10.1 This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction].
    10.2 Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in [Jurisdiction].
  10. Dispute Resolution
    11.1 In the event of a dispute, the parties will attempt to resolve the matter through negotiation or mediation before resorting to legal action.
    11.2 If the dispute cannot be resolved through alternative dispute resolution, it will be handled in a court of competent jurisdiction.
  11. Indemnity
    12.1 The Client agrees to indemnify and hold harmless the Company, its employees, agents, and subcontractors against any claims, losses, or damages arising from the Client’s breach of this Agreement or any negligent actions.
  12. Amendments
    13.1 The Company reserves the right to modify or update these Terms and Conditions at any time. Any such changes will be communicated to the Client and will apply to services rendered after the change is made.
  13. Entire Agreement
    14.1 This Agreement constitutes the entire agreement between the Client and the Company regarding the services provided and supersedes any prior agreements or understandings, whether written or oral.
